Welcome to KitaKita. These Terms of Service ("Terms") govern your use of the KitaKita mobile application ("the App") operated by ECAPS.DEV ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to create an account and use KitaKita. Users between 13 and 17 years old should have their account created or supervised by a parent or legal guardian. By using the App, you represent that you meet this age requirement.

2. Account Registration

To use KitaKita, you must create an account by providing accurate and complete information, including your name, email address, and date of birth. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

KitaKita is a family safety application that provides:

• Real-time location sharing among members of your family circles
• In-app messaging within family circles
• Event coordination for family activities
• SOS alerts with location sharing to designated emergency contacts via in-app notification and SMS
• Family circles for organizing groups of family members with invite codes

4. Acceptable Use

You agree to use KitaKita only for its intended purpose of family safety and coordination. You agree NOT to:

• Use the App to stalk, harass, or monitor any person without their knowledge and consent
• Add individuals to circles without their explicit consent
• Use the SOS feature for non-emergency purposes or to send false alerts
• Attempt to access other users' data outside of your authorized circles
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any illegal purpose under Philippine law or any applicable jurisdiction
• Transmit harmful, abusive, threatening, or otherwise objectionable content through the messaging feature
• Circumvent any security features or access restrictions of the App

5. Location Services and Permissions

KitaKita requires access to your device's location services, including background location, to provide real-time family tracking and SOS features. You may revoke location permissions at any time through your device settings; however, this will limit core functionality of the App.

The App also requests SMS permission solely for sending SOS alert messages to your emergency contacts. The App does not read or access your SMS inbox.

6. Family Circles and Consent

By joining a family circle, you consent to sharing your location and profile information with all members of that circle. You may leave a circle at any time, which will immediately stop sharing your data with that circle's members.

Circle creators and administrators are responsible for ensuring that all members have provided informed consent to participate.

7. Intellectual Property

The App, including its design, code, graphics, logos, and content, is owned by ECAPS.DEV and is protected by Philippine intellectual property laws (Republic Act No. 8293). You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User-Generated Content

You retain ownership of content you create within the App (messages, event descriptions, profile information). By using the App, you grant us a limited license to store, process, and transmit this content solely for the purpose of providing the service to you and your circle members.

9. Disclaimer of Warranties

KitaKita is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that:

• The App will be available at all times without interruption
• Location data will be perfectly accurate at all times
• SOS alerts will be delivered instantaneously in all network conditions
• The App will be free of bugs, errors, or security vulnerabilities

KitaKita is not a substitute for emergency services. In any emergency, always contact your local emergency services directly (e.g., 911 or your local emergency number).

10. Limitation of Liability

To the maximum extent permitted by Philippine law, ECAPS.DEV shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App
• Inaccurate location data or delayed notifications
• Failure of SOS alerts due to network conditions, device settings, or third-party services
• Unauthorized access to your data resulting from your failure to maintain account security
• Actions of other users within or outside your family circles

11. Data Privacy

Your use of KitaKita is also governed by our Privacy Policy, which describes how we collect, use, and protect your data in compliance with Republic Act No. 10173 (Data Privacy Act of 2012). The Privacy Policy is incorporated into these Terms by reference.

12. Account Deletion

You may delete your account at any time through the App's settings. Upon deletion:

• All your personal data will be permanently removed within 30 days
• Your membership in all circles will be terminated
• Your messages, events, and location history will be purged
• This action is irreversible

13. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms, engage in conduct harmful to other users, or if we are required to do so by law. Upon termination, your right to use the App ceases immediately.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the effective date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.
